Is the AIMA “Fast-Track” Lawsuit Worth It?

On May 24, news was published regarding a court decision ordering the Agency for Integration, Migration and Asylum (AIMA) to issue a decision within 30 days on the application of an immigrant who had expressed interest in residing in Portugal in December 2021.
What does the decision say?
According to the court, AIMA delayed the process due to “administrative inertia.” Although the lawsuit requested approval of the application, the court only ordered the authority to issue a decision within 30 days. In practical terms, this means that the application covered by the ruling will move ahead of others in AIMA’s processing queue.
Can I also file a lawsuit?
Following this news, the possibility of seeking residence authorization through judicial action has gained renewed attention. It is important to clarify that judicial proceedings may accelerate the process, but they do not guarantee approval.
All documentation must fully comply with legal requirements. If the application is granted judicial priority and AIMA later determines that the submitted documents do not meet the legal standards, the request may still be denied.
